Design Within Reach (DWR) a retail seller of furniture with retail stores throughout the United States, began selling Heller's Bellini Chair to the public in 1999 through its retail stores, catalogs and the internet. For many years, DWR was Heller's largest retail customer for the Bellini Chair until recently, when DWR apparently decided to offer for sale a less expensive confusingly similar chair.

So, how would your income and quality of life be affected if your Trademark Registration was found to be invalid and unenforceable, either by a Court of Law or the Trademark Trial and Appeal Board, at the Trademark Office? Would you be angry, frustrated and unhappy? Would you feel cheated?  It could happen quite easily, and over something that you might not have really thought about, i.e., over the fact that you and/or your trademark attorney failed to correctly and properly allege the date of first use of the mark in commerce, during the trademark application process that led to the issuance of your Trademark Registration.
